Client
Responsibility
Accessible Journeys (AJ) and all agencies in cooperation with this
travel program, act only as agents for the hotels, airlines, bus companies,
sight-seeing tour services, railroads, shipliners, or owners and contractors
of other services.
All such tickets, exchange orders and vouchers from the aforementioned
service providers are subject to any and all tariffs, terms and conditions
stipulated and designated by the contracting companies at the time
of bookings.
Upon acceptance of AJ's membership and/or such coupons, exchange orders,
receipts, contracts and tickets, member(s) agrees to the foregoing
and also agrees that AJ, nor any of their affiliates or subsidiaries
shall be or become liable or responsible for:
Any loss or damage to person, property or otherwise in connection
with any accommodations, transportation or other services, resulting
directly or indirectly from any act of God, dangers, incidents, fire,
breakdown in machinery, or equipment, acts of government or other
authorities, wars whether declared or not, hostilities, civil disturbances,
strikes, riots, thefts, pilferage, epidemics, quarantines, medical
or customs regulations, defaults, delays or cancellations of, or changes
in, itinerary or schedules from any causes beyond our control.
Any loss or damage resulting from insufficient or improperly
issued passports, visas or other documents.
Any additional expenses or liabilities sustained or incurred by the
travel member as a result of any of the foregoing causes. The right
is reserved by AJ to substitute hotels and alter the itinerary, or
reverse the order of places to be visited. The right is reserved to
cancel the tour prior to departure. Should the tour be canceled, an
alternative date will be given. Participation in the alternative tour
date is optional and the liability to AJ is limited to the moneys
received by AJ. Accessible Journeys or its subsidiary will not be
held responsible/liable for defaults of employees under its control.
Cancellation
and Refunds of Cruise arrangements
Deposit confirmation of $250.00 per person due within 7 days
of this confirmation to retain your bookings
$150.00 per person of your deposit confirmation is non-refundable
Final balance of payment due 90 days before departure
Tour price subject to change and is based on currency valuation
of the US Dollars versus the (Foreign currency name, EURO, British
Pound, etc.) at the time of payment to our suppliers
Requests for cancellation must be made in writing and have
acknowledgment by Accessible Journeys
Payments made within cancellation period subject to cancellation policy
Cancellations up until the time of final payment are subject to a
service charge of per person ($50.00 per person minimum)
*All cancellations include additional penalties of 100% of expenditures
made on your behalf.
Cancellation>91 days =$150.00 per person & * from above
cancellation 90-76 days = 100% of deposit & * from above
cancellation 75-61 days = 100% of tour price & * from above
No show or no use of services = 100% penalty = no refund
Cancellation penalties apply as stated above, regardless of date that
final payment is invoiced, or received.
We reserve the right to charge a fee of up to 10% of the trip
costs for travel arrangements cancelled after deposit and/or final
payment for this trip is made.
Changes made after final payment subject to local fees, plus
supplier fees (if applicable) and a $50.00 service fee, per change,
from our agency.
"Goodwill Deposits" and/or "Prepare to Travel
Deposits" are not applicable towards payment of trip costs, airfare,
or travel insurance.
Disclaimer
& Denial by Accessible Journeys
In the provision of its services Accessible Journeys undertakes
no direct provision of medical or nursing services to clients unless
specifically contracted for, for a separate fee. It is not in the
travel transportation business directly, and does not own, control
or have a direct financial interest in travel or accommodation facilities
or how such facilities are managed or maintained. As a result, Accessible
Journeys is not responsible for changes in scheduling, or maintenance
or facilities or equipment of such facilities beyond the undertaking
of its best efforts to seek out and arrange the best service available
at the time for the destination and travel plans of each the client.
Accessible Journeys does not insure the client in any respect whatsoever
against any loss, injury or damage sustained by the client during
the course of any journey for which the client has contracted services
from Accessible Journeys.
In the event that the client claims in any respect that Accessible
Journeys has failed to provide the services contracted for, the client
hereby acknowledges and agrees that clients sole remedy against Accessible
Journeys is for failure to provide services contracted for, and that
the limit of Accessible Journeys liability is the commission earned
by Accessible Journeys. Accessible Journeys accepts no responsibility
for losses or additional expenses due to delay or changes of schedules,
weather, strikes, war, quarantine, illness, death, or other causes.
All rates and fares reflected in the itinerary are based upon current
tariffs at the time of printing and are subject to adjustment in the
event of changes at the time of final payment. Accessible Journeys
reserves the right to accept or reject any person as a member of any
tour, and to refuse to undertake any further services for any individual,
for reasons at the discretion of Accessible Journeys. In this event,
Accessible Journeys shall return any unused moneys paid to Accessible
Journeys (minus a $150.00 service change by Accessible Journeys,)
and after applicable penalties and tariffs are applied by other suppliers.
In such an event, this contract shall be canceled. Accessible Journeys
further reserves the right to cancel or alter any tour or arrangements
herein described or advertised, at its discretion for any reason,
in which event, Accessible Journeys will return any unused moneys,
(minus a $50.00 service charge, if applicable), likewise, this contract
is canceled and no further force or effect.
Names of hotels mentioned in the above itinerary only indicate
that our rates are based on the tariffs of the respective hotels.
Accommodation for you are being held at these hotels until confirmation
is received from the respective hotels and communicated to you. If
accommodation is not available at any of the hotels mentioned, bookings
will be made at similar or next best available hotels.
Similarly, reservations on the flights mentioned in the above
itinerary are not to be treated as definite unless flight tickets
have been purchased on your behalf and confirmed by the airline or
airlines. As with any flight arrangements, flight numbers and departure
times are subject to change.
Despite written confirmation of reservations, and/or purchase
of airline tickets, there always remains a slight possibility that
hotels and/or airlines may have confirmed reservations in excess of
their capacity ,i.e "made over bookings." In this instance
we will be required to use different hotels and flights based on availability
and/or change the itinerary without prior notice. While this is seldom
necessary, the possibility always remains when reserving and implementing
any travel arrangement(s).
Despite written confirmation of reservations of accommodations
meeting your access/accessibility requirements, there always remains
the possibility that hotels having confirmed reservations may have
made errors in reporting accessibility standards or provided inaccurate
information/details to our suppliers/colleagues. Similarly, accommodations
meeting your requirements, may be unavailable for the time requested,
or unavailable in the region of travel.
Travel
Insurance
Comprehensive travelers insurance is required by every client of Acessible
Journeys. It is also acknowledged that comprehensive travel insurance
has been explained, recommended and made available from Accessible
Journeys. A full description of the insurance benefits and service
limits, including restrictions and limitations have been provided
for each clients' review. Accessible Journeys' provides explanations
for evaluation purposes only. The client assumes fully responsible
to understand the benefits of any insurance policy and assumes full
responsible for accepting or rejecting insurance coverage. Accessible
Journeys' requires that each client is fully insured to protect their
personal interests to the full cost of the trip planned by Accessible
Journeys.
Methods
of Payment
Goodwill Deposits and/or Prepare to Travel Deposits: Not applicable
towards payment of land costs, airfare, or travel insurance.
Payment(s) for land arrangements: Acceptable forms of payment:
Personal check, bank check, money order, wire transfer. Credit cards
not accepted for land arrangements.
Payment for air arrangements: Preferred by credit card. Other
forms of payment are available, but these will postpone your transaction.
Payment for Travel Insurance Preferred by credit card. Other
forms of payment are available, but these will postpone your transaction.

Responsibility
and Agreement of Accessible Journeys' Client
A.) The client authorizes and agrees that Accessible Journeys
(AJ) is authorized to act as the clients agent for purposes of contracting
travel and accommodations arrangements. The client further agrees
to forward such sums as may be necessary from time to time as notified
by AJ in accord with the itinerary. The client further acknowledges
that travel arrangements are subject to rapid change due to circumstances
not with AJs control, and therefore authorizes AJ to substitute
facilities of similar nature and quality as originally planned, as
judged with AJ's sole discretion. Failure of the client to forward
such amounts as may be necessary to meet the obligations as contained
in the itinerary shall terminate the obligation of AJ to perform any
further services on behalf of the client, in which event fees and
commissions paid to AJ shall be retained by AJ unless otherwise agreed
to in writing.
B). In the event that the client is unable to attend the travel arrangements arranged through AJ, or to otherwise not attend to any events scheduled as part of any such arrangements, the client has no right to a refund from AJ for services or arrangements made by it, its agents, servants, or employees, and must look to such travel accommodations, or event companies or businesses for refunds as a result of such cancellations. However AJ may, at its discretion, aid the client in obtaining such refunds as may be available.
C. The client, in addition to payment of the fees set forth above, and not AJ, its agents, servants or employees is responsible for obtaining and/or providing passports, visas and associated fees. The client is also responsible for all airfares and ground transportation costs other than may be made part of the itinerary, meals other than may be part of the itinerary, excess baggage charges, lost baggage, laundry, wines or liquors, souvenir, personal items, and personal pursuits, associated health club, spa, or treatment facilities, touring guides or tour programs other than made part of the itinerary, admissions to attractions, such driving or other licenses as may be required at each destination, insurance covering baggage loss, medical coverage, accidents during the course of travel, death, dismemberment or injury to the client, or caused by the client, or the clients agent, servant or employees.
D. The client further acknowledges that the arrangements for which AJ is providing services are not being made contrary to the advice of the client's physician or caregivers. Regardless of such advice, the client agrees to indemnify and hold AJ, its agents, servants and/or employees harmless and without responsibility for any claims which may arise as a result of change in travel plans or accommodations, loss of property, baggage or funds, pain, suffering, harm or injuries suffered by the client during the course of the arrangements, whether a direct result of the client's health condition, the result of a third party, war, acts of god, or by the actions or inaction of the companion arranged by AJ, and hereby agrees that such indemnification shall be binding upon the client, the client's guardian subsequently appointed, the clients personal representatives, heirs and beneficiaries. The client further certifies that there is no legal disability limiting the clients ability to enter into this agreement (client has not been declared incompetent, suffers no debilitating mental illness, and was not coerced into entering into this agreement) and that the client can read and write the English language and has read, or had this agreement read aloud to him/her, and agrees and understands its terms and provisions.
E. The client further agrees that any photographic images, video or digital images that are presented to, bought, obtained by, or recorded by Accessible Journeys, are the sole property of AJ and may be used by AJ, at its discretion, for matters of advertising, and/or displaying services in printed materials, or on the Internet, without compensation due to the client, their guardians subsequently appointed, their personal representatives, their heirs and beneficiaries.
F. The client further acknowledges that they understand and agree to the full terms and conditions of this agreement.
G. All parties agree that payment and/or signature of this release by one party, constitutes payment and signature for all parties.
Acknowledgment
of Terms
While every effort has been undertaken to arrange a wheelchair
accessible program, the clients understand that certain destinations
and hotels with developing tourism may lack facilities required or
desired for the participants specific accessibility needs. Medical
services may not be readily available or accessible on this travel
program.
Payment of deposit moneys and/or full tour payment acknowledges
the client's full understanding of the terms and conditions contained
in this document.
